BACI PERUGINA CONTEST


1. CONTEST PERIOD:

Contest begins September 27th, 2011 (12:00:00 EST) and ends February 13th, 2012 (23:59:59 EST).

2. HOW TO ENTER:

No Purchase Necessary: To enter, go to http://www.baciperugina.ca or Facebook: Baci Chocolate – Kisses For Canada, carefully read and accept the contest rules and follow the instructions to register. The instructions include: enter and confirm your email address, your full name, full postal address, including city, province, postal code , daytime telephone number and also a love note (100 characters max.). You will also have to carefully review and accept the Declaration and Release box to enter the Contest.

Once you have completed the online registration process, click "submit." Upon successfully registering, you will earn one (1) entry in the Contest.

You may only enter the Contest once per day on Facebook, Twitter, and www.baciperugina.ca. Any attempt to enter more than one Entry by using multiple/different email addresses, identities, registrations and/or logins, or any other methods will void all your entries and you will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder.

All entries must be received during the Contest Period.

3. GRAND PRIZE:

There is one (1) grand prize available to be won and it consists of:

One (1) $5,000 CND voucher from Flight Centre and $500 spending money.

The winner can exchange the travel voucher for a trip of his/her choice, subject to Flight Centre’s terms and conditions that may include an expiration date and prepayment of taxes and fees. The following trip to Italy is suggested and it could include:

  • Depart from closest major airport (ground transportation to and from airport is not provided) land in Rome, Italy.
  • Transfer to Hotel
  • 3 Nights 4 Star Grand Hotel Beverly Hills - incl Buffet Breakfast
  • Rome full day city tour
  • Train from Rome to Perugia - 2hr 41mins
  • 2 nights 4 Star La Meridiana - incl Buffet Breakfast
  • Train from Perugia to Venice - 4hr 59min
  • 2 nights 4 Star Cavalletto & Doge Orseolo Hotel - incl Buffet Breakfast
  • Venice full day city tour
  • Depart Venice for return flight to Canada

Where you go and how you spend the voucher is up to you!. It is the sole responsibility of the winner and his/her guest to obtain all necessary travel documentation including passports and/or visas if applicable and to comply with any customs and immigration requirements. The winner can customize his/her trip but the $5,000 CND travel voucher must be exchanged at Flight Centre. The winner must have a valid credit card to present upon check-in and for incidentals. None of Global Appetite Inc., Nestle Italiana SpA, and Flight Centre and each of their respective parent companies, shareholders, subsidiaries, affiliates, directors, officers, directors, employees, governors, franchisees, and agents makes any express or implied warranties of any kind with respect to safety, or performance, of the prize. The spending money will be remitted to the winner in the form of a prepaid Visa card or a cheque;

Approximate retail value of the grand prize is $5,500 CDN

Global Appetite Inc. and/or its representatives reserve the right at any time and at its sole option to: (a) place reasonable restrictions on the availability or any aspect of the prize; or (b) substitute the prize or any aspect of the prize for any reason so long as a prize or aspect of the prize of comparable price is substituted.

On February 14th, 2011 a random draw will be made from all entries. The odds of being selected will depend upon the total number of eligible entries received during the Contest Period.

The Contest winner will be contacted via telephone and/or email notification. If the Contest winner does not respond to Global Appetite Inc.’s telephone or email message before 17:00:00 on February 21, 2012 he/she will be disqualified and another entry will be drawn and a new winner selected. No communication will be entered into except with the selected entrant(s).

SECONDARY PRIZES:

Eight (8) Secondary Prizes will be awarded, each consisting of a $200 voucher redeemable at participating Bed & Breakfast locations across Canada.

It is the sole responsibility of the winner and his/her guest to arrange and pay for his/her own transportation to the Bed & Breakfast and his/her stay is subject to the rules of the Bed & Breakfast that may include providing a credit card imprint. Neither Global Appetite Inc. nor Nestle Italiana SpA nor BBCanada.com (Bed and Breakfast Online Canada Inc), and each of their respective parent companies, shareholders, subsidiaries, affiliates, directors, officers, directors, employees, governors, franchisees, and agents makes any express or implied warranties of any kind with respect to safety, or performance, of the prizes.

Global Appetite Inc. and/or its representatives reserve the right at any time and at its sole option to: (a) place reasonable restrictions on the availability or any aspect of the prizes; or (b) substitute the prizes or any aspect of the prizes for any reason so long as a prizes or aspect of the prize of comparable price is substituted.

The draws for the Secondary Prizes occur over a twenty-four (24) week period in eight three-week contest periods. Each of the eight (8) secondary prize contests will run for a period of three (3) weeks beginning October 1st 2011. For the first two (2) weeks of each three-week contest period Love Notes will be pooled. From this accumulation, ten (10) Love Notes will be selected to be placed on Facebook for voting. During the final one (1) week of each three-week contest period Facebook members will vote on the ten (10) selected Love Notes. At the close of the third (3rd) and final week of the contest, the submitter of the Love Note with the most votes will win the Bed and Breakfast prize. In the event of a tie, a random draw will be made from the two love notes with the most votes.

The Secondary Prize Contest winners will be contacted via Facebook, telephone and/or email notification. If a winner does not respond to Global Appetite Inc.’s Facebook, telephone or email message within 168 hours of it being sent, he/she will be disqualified and the next popular Love Note submitter will be deemed to be the winner. No communication will be entered into except with the winning entrant(s).

DRAWING:

Each of the eight (8) secondary contests will run for a period of three (3) weeks beginning October 1st 2011. For the first two (2) weeks of each contest period Love Notes will be pooled. From this accumulation, ten (10) Love Notes will be selected to be placed on Facebook for voting. During the final one (1) week of each contest period Facebook members will vote on the ten (10) eligible Love Notes. At the close of the third (3rd) and final week of the contest, the Love Note with the most votes will win the Bed and Breakfast prize.

Please note, once an individual has won a secondary prize, they are no longer eligible for any future draws for the secondary prizes (Bed and Breakfast) However, they are still eligible to win the Grand Prize of a trip for two (2) to Italy.

4. ELIGIBILITY:

To enter and be eligible to win, a person must be a resident of Canada (excluding Quebec) who is 18 years of age or older at the time of entry, and have a valid email address. Persons in any of the following categories are NOT eligible to participate or win prizes in the Contest: (a) any person who, at any time on or after September 27th, 2011, was or is a director, officer, employee (and members of the immediate families and households of such employees), or service agencies, or independent contractors of Aurora Importing & Distributing Ltd., Global Appetite Inc.; (b) individuals engaged in the development, production or distribution of materials for the Contest; (c) a prize supplier; and (d) any person domiciled with any of the above. In these Official Rules, "immediate family" means parents, children, siblings and spouse.

By entering the Contest the entrant agrees to the Contest rules and to the use of his/her name, and address without compensation for all publicity purposes related to the Contest including posting on Baci Perugina’s web site.

Before being declared a winner, a selected entrant must: (i) be in full compliance with these rules; (ii) answer a skill testing question before being declared a winner, (iii) sign and return Global Appetite’s Inc. Release and Indemnity Form within 10 days of it having received it and the release will include a statement indicating that the winner waives all recourse against the Released Parties (defined below) and those associated with the Released Parties with respect to liability of any kind including in relation to having entered into the Contest and accepting or utilizing the Prize. Potential prize winners who do not or fail to comply fully with the Contest rules will automatically forfeit their opportunity to win that prize and nothing else will be substituted or given to that potential winner and an alternate winner may be chosen in their place.

5. GENERAL RULES:

Contest is being sponsored by Global Appetite Inc. and Its representatives in respect of any matter related to this Contest (either before or following selection) is final and without appeal. Contest is subject to all applicable Federal, Provincial and Municipal laws.

All entries and Love Notes become the property of Global Appetite Inc. upon submission. All Love Notes must be original to the person submitting them and must not infringe anyone’s intellectual property or other rights nor defame or otherwise injure any person. Entries will be rejected if Global Appetite Inc. believes in its sole discretion that a Love Note is unoriginal, defamatory or injurious, or if an entry is not fully completed. Persons tampering with or abusing the entry policy will be disqualified. Global Appetite Inc., including representatives and those associated with them, is not responsible for any entry, a prize winning notification or the claim for prize that fails to get entered, is lost, misdirected or which arrives late, as the case may be, whether or not due to the fault of Global Appetite Inc. or of any other person or thing and whether or not due to an interrupted or unavailable browser or network server or malfunction, congestion, incompatibility, misconnection or miscommunication, failed or lost computer transmissions, or if Global Appetite Inc. Email/Web site portal is compromised by virus, bugs, unauthorized human or unauthorized non-human intervention, or for any technical malfunction of any telephone network or lines, computer on line systems, servers access providers, computer equipment, software failures, or failure of any entry to be received due to technical problems or traffic congestion on the Internet or Global Appetite Inc.’s web site or other similar technical problems beyond the reasonable control of Global Appetite Inc. (collectively, the "technical problems"). Global Appetite Inc. reserves the right to cancel, terminate, modify, amend or suspend the on-line portion of the Contest, in its sole discretion, if any of the foregoing technical problems prevents the fair or proper administration of the on-line portion of the Contest and if Global Appetite Inc. does so, in the sole discretion of Global Appetite inc., Global Appetite Inc. further reserves the right when terminating the on-line portion of the Contest to conduct the Contest that includes those valid on-line entries previously received during the Contest Period. Global Appetite Inc.will have no liability whatsoever if for any reason the Contest is not capable of running as planned due to technical problems, including due to computer virus, bugs, unauthorized tampering, unauthorized intervention, fraud, technical failures, or any other causes. Global Appetite Inc. reserves its right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these rules or otherwise in a disruptive manner. Global Appetite Inc. shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant's computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest Website or elsewhere.

Prize must be accepted as awarded, in the name of the winner (who must be the person who submitted the entry), is not transferable, or prize may be substituted for a cash equivalent (and without limiting the foregoing, prizes may not be sold or traded). In the event of a dispute over the identity of the person who submitted the entry, the entry will be deemed to be submitted by the authorized account holder of the e-mail account through which the entry was made. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential winner may be requested to provide Global Appetite Inc. with proof that the potential winner is the authorized account holder of the email address associated with the potentially winning entry.

By completing the entry form all entrants consent to the collection, use and distribution of their personal information by Global Appetite Inc. for the purposes of running the Contest and as permitted by these rules (for example, pursuant to these rules, all entrants who accept a prize consent to the use of their personal information for publicity usages) including as permitted by any release signed. Personal information is defined as anything that identifies an entrant as an individual, such as home telephone number, age, home address, email address, gender. Global Appetite Inc. will not sell or transmit this information to third parties except for the purposes of administering the Contest. Entrants are invited to view Global Appetite Inc.'s privacy policy on www.baciperugina.ca. By entering the Contest, entrants agree to hold harmless and indemnify Global Appetite Inc., Nestle Italiana SpA, BBCanada.com (Bed and Breakfast Online Canada Inc.) and each of their respective parent companies, shareholders, subsidiaries, affiliates, directors, officers, directors, employees, governors, franchisees, and agents, (collectively, the "Released Parties") against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) entrant's participation in the Contest, (ii) the receipt or use of the prizes awarded therein; and (iii) the administration of the Contest and distribution of the prizes awarded therein.
